Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

Congratulations to Susan Parzymieso for obtaining a disallowance of a claim following testimony of the claimant, employer witnesses, attending physicians and IME medical expert.

This case involved a claimant who alleged a gradual onset left shoulder injury associated with his duties as a bus driver, culminating in a reported sharp pain on November 20, 2025.

A key component of the defense was an Independent Medical Examination conducted after the IME physician reviewed approximately 12 hours of video footage documenting the claimant performing his regular job duties—specifically, operating a bus and using the steering wheel. The footage showed the claimant performing normal driving activities without sudden movements, traumatic forces, or biomechanical stress consistent with an acute or cumulative shoulder injury. There was no observable event that could medically explain the onset of the alleged condition.

The IME physician explicitly highlighted these observations in the report, noting that the claimant’s demonstrated activities and timeline were inconsistent with his reported history and that there was no identifiable mechanism of injury shown on the video that could account for the claimed shoulder pathology.

In contrast, Susan was able to elicit testimony from the treating providers wherein they conceded that they did not have a full understanding of the physical demands of the job, how the job duties are performed and the alleged mechanism of injury.

This win is a textbook example of how building a case with thorough investigation + video evidence + disciplined medical analysis and testimony can overcome medical reports submitted by treating physicians finding causal relationship of an injury to a claimant’s “job duties”.
Outstanding work by Susan!👏
