Congratulations to Russell Hall on securing another excellent result for the defense.
In this case, the claim was established for the left hip only, but the claimant sought to expand the claim to include the neck, low back, left knee, left ankle, and left foot. Following detailed testimony of the claimant and employer witness, Russ was able to establish that the initial medical reports made no mention of the additional injury sites and that the notice given to the employer only included the injury to the left hip. The Law Judge disallowed all of the alleged injury sites other than the left hip. The only medical evidence supporting lost time was for the disallowed injury sites. The Law Judge found that there was no causally related lost time from work. The decision reinforces the principle that allegations by a claimant, alone, are not enough to establish a claim.
A great outcome.
Well done, Russ.
