Big win and well-deserved recognition for Russell Hall.
Congratulations to Russ on securing a Workers’ Compensation Law §114-a finding resulting in a lifetime disqualification from benefits in a highly contested case.
This matter involved complex medical and factual issues, including disputed causation of an alleged shoulder injury and testimony regarding significant physical limitations. Through sharp cross-examination and careful development of the record, Russ exposed critical inconsistencies between the claimant’s testimony, medical history, and contemporaneous records.
Notably, the treating physician ultimately withdrew support for causal relationship after being confronted with contradictory evidence. The case also presented unique challenges during testimony, further underscoring the importance of precision and persistence in litigation.
In a particularly striking moment, real-time video evidence directly contradicted the claimant’s sworn testimony, reinforcing the broader pattern of misrepresentation that led to the §114-a finding. After summations, the Law Judge ruled that the claimant should be disqualified from all further WC benefits based upon misrepresentations involving the right shoulder. While the Judge was making his ruling, the claimant’s camera froze for several minutes. When the claimant appeared back on camera, he was driving a very large box truck in direct contradiction of the medical reports submitted on his behalf stating that he is totally disabled for work and cannot drive a vehicle. Russ brought this information to the attention of the Law Judge during the preceding. The Law Judge took notice and detailed what was viewed on camera. The activities viewed on the camera further bolstered the brazen nature of the Section 114-a misrepresentations.
The Law Judge’s decision finding a permanent ban for WC compensation benefits reflects the egregious nature of the misrepresentations.
Excellent work, Russ.
