Congratulations to John Coyle and the team at Hamberger & Weiss on another successful result.
Following a hearing before the New York Workers’ Compensation Board, the claim for causally related hearing loss due to employment as a truck driver was disallowed as untimely filed, in accordance with Section 28 and Section 49-bb of the Workers’ Compensation Law. The Law Judge adopted the defense position that the claimant failed to timely file the claim for hearing loss within 2 years of notice that the claim was related to his employment, and within 90 days of constructive notice of that fact.
Excellent work securing a strong outcome for the client through thorough preparation, strategic advocacy, and a clear presentation of the applicable law.
