Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

Congratulations to John Terzulli on another outstanding result for our client.
We are proud to recognize John Terzulli for securing another significant victory in a New York Workers’ Compensation Schedule Loss of Use (SLU) case.

Rather than relying on an Independent Medical Examination or cross-examination of the claimant’s treating physician, John focused on a strategic legal analysis of the Workers’ Compensation Impairment Guidelines. He successfully argued that the treating physician improperly increased the claimant’s Schedule Loss of Use by adding 10% for an alleged “irreparable rotator cuff tear,” even though the Guidelines do not recognize this as a special consideration. He also demonstrated that the physician incorrectly added an additional 10% for mild deficits in internal and external rotation, contrary to the Guidelines, which prohibit cumulative additions for those findings. The Board’s decision reflects these guideline-based arguments and reduced the overall Schedule Loss of Use accordingly.

As a result, the claimant’s opinion of a 40% Schedule Loss of Use of the right arm was reduced to an overall 20% Schedule Loss of Use, with 50% apportionment, resulting in a net Schedule Loss of Use of just 10%.

This outcome generated an estimated $58,757.09 savings for our client and demonstrates how a thorough understanding of the Workers’ Compensation Guidelines can produce exceptional results without the need for additional medical testimony.

Congratulations, John, on another outstanding victory and for your continued commitment to delivering exceptional results for our clients.
