Congratulations to Russell Hall on another significant Workers’ Compensation victory!
We are proud to recognize Russ Hall for successfully defending a highly contested New York Workers’ Compensation claim that required months of litigation, extensive investigation, and strategic advocacy.
The claimant, a carnival ride operator at the New York State Fair, alleged that she was injured after signing in for work and walking to a restroom. Throughout the litigation, the employer maintained that the claimant had not signed in and was not in the course of her employment at the time of the alleged accident.
To build the defense, Russ conducted multiple FOIL requests that uncovered critical evidence, including a New York State Fairgrounds Incident Report. He also developed a compelling factual record through witness testimony, timecards, maps of the fairgrounds, and careful examination of the evolving medical allegations, demonstrating significant credibility concerns as the claimed injuries expanded over time. Moreover, Russ deposed the medical provider whose report formed the basis of a PRME finding for the back and neck and under cross-examination the provider has to recant causal relationship when presented with prior medical reports that did not support the onset of symptomatology contemporaneous with the work injury.
After months of litigation, the Workers’ Compensation Law Judge agreed with the defense, finding that the claimant did not sustain an injury in the course of employment and was not within the precincts of her employment under the “gray area” doctrine established in Husted. As a result, the claim was disallowed in its entirety.
This outstanding result reflects the persistence, strategic preparation, and attention to detail that Russ brings to every case. We also appreciate the collaboration of the employer representative and insurance carrier throughout the litigation, whose partnership helped achieve this successful outcome.
Congratulations, Russ, on a well-earned victory and another outstanding result for our client!
