Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

Congratulations to Russell Hall on securing a significant win in a highly contested workers’ compensation matter!!

In this case, the claimant attempted to expand a 2015 claim—originally limited to a left shoulder strain—by adding left hand and wrist injuries nearly a decade later in pursuit of additional benefits.

Through strategic deposition work, Russ successfully obtained testimony from the treating physician disavowing his initial report finding causal relationship between the established 2015 left shoulder claim and the newly reported alleged chronic left hand/wrist condition.

At the hearing, Russ not only defeated the claim on lack of causal relationship, but also successfully advanced a laches defense given the extraordinary delay in raising the issue.

From the bench, the Law Judge disallowed the additional sites which would have led to a costly schedule loss of use award.

Excellent work and a great example of how disciplined litigation strategy and effective cross-examination can drive the right outcome.
