Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

Congratulations to Susan Parzymieso on securing a strong result in a recent Workers’ Compensation matter. As an attorney, it is always a difficult decision to waive the testimony of a treating physician on schedule loss of use. Susan demonstrated expert judgment in declining to take the testimony of the treating physician on a schedule loss of use case where the surgeon opined a 50% SLU of the arm following a total shoulder arthroplasty.

By strategically waiving depositions and submitting a targeted brief, the argument that the treating provider failed to properly apply the 2018 Impairment Guidelines ultimately carried the day. The WCLJ awarded 39% of the arm. The difference in the schedule loss of use award was just under $40,000!

Well done, Susan
