Our partner Brian Schaedler was facing a report from a treating doctor in a recent case that found significant impairments of both legs and the right foot. Altogether, the treating doctor’s report, if believed, would have awarded the claimant almost $235,000. Brian argued that the worker had only lost about 2 months of time from work and has been working in his preinjury job for several years. He argued further that there was no credible medical evidence of significant impairment. He highlighted the discrepancies in the claimant’s range of motion in his extremities between the most recent evaluation of the treating doctor and prior examinations, lack of treatment, and the worker’s ability to perform his preinjury job without restrictions. The judge agreed with Brian, finding the treating doctor’s permanency assessment incredible and making a much smaller award based on the insurance company’s medical consultant instead that, based on credits for payments already made, resulted in no additional money owed.
