HAMBERGER & WEISS LLP wins major fraud case which results in criminal conviction, restitution payment and forfeiture of future medical!

Hamberger & Weiss LLP associate attorney, Victoria Hahn, obtained a section 114-a permanent disqualification from workers’ compensation benefits by proving that a claimant committed fraud as he collected lost wage benefits while operating a personal business. The Administrative Law Judge found that Tori substantiated the violation of section 114-a by demonstrating that the claimant was actively performing business activities while collecting Workers’ Compensation benefits. The decision of the Law Judge was affirmed by the Board Panel and the claimant was assessed a mandatory penalty in the amount of $62,462.48 and a discretionary penalty with a permanent disqualification of all further indemnity benefits.

Based upon the successful 114-a fraud defense and the evidence produced before the Workers’ Compensation Board the claimant was criminally convicted of insurance fraud in the 5th degree per a plea deal with restitution directed to the insurance carrier in the amount of $30,000, a forfeiture of all indemnity benefits and future medical rights under the workers’ compensation claim.
