A chef alleged bilateral shoulder and elbow injuries from repetitive kitchen duties. His treating physician backed the claim in writing. Then H&W’s Wendy Hauck deposed the doctor, and he undermined his own opinion. The treating physician testified that connecting the claimant’s condition to his job was a “hard sell.” He further admitted that epicondylitis develops across all professions, regardless of work duties.
Wendy recognized the significance of what had just happened, and she made sure the record reflected it. The Law Judge disallowed the claim, finding the medical opinion insufficient to establish causation.
When causation rests on shaky or vague medical assumptions, securing medical testimony can make all of the difference. Congratulations to Wendy Hauck on a well-earned win!
