Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

In a recent Workersโ€™ Compensation matter, Russ successfully defended against an attempt to dramatically expand a claim beyond the originally established left hip injury. The claimant sought to add multiple additional body sitesโ€”including the neck, low back, knee, ankle, and footโ€”and pursued awards that could have reached back to the original injury date.

After litigation and testimony, the Workersโ€™ Compensation Law Judge disallowed all additional claimed injury sites.

Critically, the claimant was also unable to establish entitlement to lost time awards. The Judge found that:

The claimantโ€™s ongoing medical treatment and alleged disability were entirely related to the disallowed additional injury sites, not the established left hip injury.

Once those additional sites were rejected, there was no medical or evidentiary basis remaining to support lost time claims.

The claimantโ€™s litigation posture relied on evolving injury allegations and unsupported histories, including inconsistent accounts of treatment and the absence of corroborating emergency or ambulance records.

With no compensable disability tied to the established injury, the claim for lost time could not be sustained.

This result reflects disciplined litigation, effective use of testimony, and a focused evidentiary challenge that held the claim to its proper legal and factual limits. Well done, Russ, on yet anotherย excellent outcome!
