Congratulations to Kathy McCann and our Loss Transfer team on an excellent result for our client. Hamberger & Weiss LLP recently secured a significant Loss Transfer recovery in a matter that highlights a frequently misunderstood aspect of New York no‑fault law: a vehicle can be deemed “involved” in an accident even when it is not part of the physical collision. In this case, the employee was a pedestrian directing traffic for a garbage truck that weighs over 6,500 pounds, when struck by another vehicle. Although the garbage truck did not make contact, its role in the overall occurrence was sufficient to establish involvement for Loss Transfer purposes that the garbage truck was “involved” in the accident —an issue that is often overlooked and initially led to a denial by the automobile carrier. Through the persistence and experience of our team, that denial was successfully challenged, resulting in a recovery of more than $33,000 on behalf of our client. This outcome reflects the depth of experience within our Loss Transfer practice and, in particular, the expertise of Kathy McCann, who brings more than 40 years of insurance and claims experience to her work. Kathy’s institutional knowledge, attention to detail, and command of no‑fault and Loss Transfer principles continue to deliver meaningful results for our clients. Well done to Kathy and the entire Loss Transfer team on another strong win.
