Congratulations to John Land on securing a complete disallowance of a controverted New York Workers' Compensation claim involving an alleged left shoulder injury.

What a hot streak! Another outstanding defense victory! Congratulations to Susan Parzymieso!

Susan recently secured a significant win in a workers’ compensation fraud case involving multiple allegations under Workers’ Compensation Law §114-a.
Through testimony of the injured worker and presentation of video surveillance, Susan was able to obtain mandatory and discretionary penalties. The evidence presented showed that the claimant failed to disclose a subsequent accident involving the same injury site, failed to report ongoing work activities while collecting indemnity benefits and made misrepresentations concerning her alleged disability to both treating providers and the IME. She presented video surveillance evidence of the claimant owning and actively working at a bar, performing tasks inconsistent with her alleged disability and her claim that she was not working. An addendum prepared by the IME physician confirmed that the claimant misrepresented her symptoms and functional capacity at the time of the evaluation.

The Workers’ Compensation Law Judge ultimately found that the claimant was working and misrepresenting her disability to obtain benefits, resulting in mandatory and discretionary penalties and a full disqualification from workers compensation benefits.

This is an excellent example of thorough investigation, effective use of surveillance, and skilled advocacy leading to a strong result.

Great work, Susan!
